LEGRAND REWARDS ‘LIVE XTRA LARGE WITH LEGRAND’ TERMS & CONDITIONS

Information on how to enter and the gifts form part of these Terms and Conditions.  

Participation in this promotion is deemed acceptance of these Terms and Conditions. 

Entry is only open to Australian residents aged 18 years or over. 

Legrand Australia Pty Ltd is the Promoter of Legrand Rewards ‘Live Xtra Large with Legrand’ promotion.

Employees (and their immediate families) of the Promoter, Participating Wholesalers (as defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunty, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 

Legrand Rewards ‘Live Xtra Large with Legrand’ promotion commences at 12:00am AEST on 4/01/2022 and close at 12:00am AEST on 15/04/2022 (“Promotional Period”). 

To be eligible to enter, individuals must purchase a specially marked Legrand Rewards Product pack from a participating wholesaler during the Promotional Period (“Qualifying Transaction,”). A participating wholesaler is any wholesaler that displays promotional material featuring this promotion (each a “Participating Wholesaler”). For the avoidance of doubt, there will be Participating Wholesalers in NSW, VIC, SA, WA, NT, ACT, TAS and QLD only. Specially marked Qualifying Product packs will each contain a custom Legrand Rewards ‘Live Xtra Large with Legrand’ voucher featuring a unique 12-digit code.  A full list of participating wholesalers can be found at https://legrandrewards.com.au/where-to-buy/

Legrand reserves the right, at any time, to update the list of participating wholesalers.

Legrand resellers may become a Participating Wholesaler during the promotional period by contacting their Legrand representative.

Upon purchasing a Qualifying Product Pack, entrants will find a Legrand Rewards ‘Live Xtra Large with Legrand’ voucher inside their product box. The card will feature a unique 12-digit code and instructions on how to redeem their points. 

How to Claim 

Claimants must, before 11.59pm AEST on 1 April 2022, redeem their points online by visiting www.legrandrewards.com.au (“Website”), complete the online registration process, inputting the requested details, including voucher code(s) from the promotional voucher(s). Once the claimant provides their requested details, they will be provided with a username and password for their account. Claimants can then revisit the Website, before 11.59pm AEST on 1 April 2022, and enter additional voucher code(s) into their account using their username and password. 

To obtain a gift, the claimant must visit the website before 11.59pm AEST on Friday 15 April 2022, and in accordance with the instructions claim the relevant gift. Claimants can only obtain a specific gift claim if they have the relevant number of points(s) in their account. Once a claimant submits a gift claim, they cannot change their mind, and the relevant points will be debited from their account. 

After 11.59pm AEST on 15 April 2022, any unused points remaining in the claimants account will be forfeited and no cash or gifts will be awarded in lieu.  

Claimants must retain all of their purchase invoices as proof of purchase. Failure to produce proof of purchase when requested by the Promoter, may result in the invalidation of all of their claims, and any right to any gift. 

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 

Incomplete or indecipherable entries will be deemed invalid. 

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

The promoter reserves the right to add, update and remove prizes during the promotional period dependant on redemptions and gift availability.  

General 

The Promoter’s decision is final and no correspondence will be entered into. 

If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 

Claims may be subject to follow up enquires or investigations or security and verification checks as the Promoter determines to apply in its absolute discretion. Claims will be ineligible if promotional vouchers (and voucher codes) are mutilated, illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way, or if these documents fail any of the Promoter’s security and verification checks. 

Points, or any unused portion of points, are not transferable or exchangeable and cannot be taken as cash. 

If for any reason a claimant does not take a gift at or by the time stipulated by the Promoter, then the gift will be forfeited. 

Claimants are required to provide all details requested by the Promoter. In the event that a claimant fails to provide any of the details requested, the claim will be invalid and no corresponding gift will be awarded to that claimant. 

Claimants must have fully paid for the Participating Product before they are eligible to submit a claim. 

Claimants are responsible for ensuring that they provide the Promoter with accurate details relating to their claim. In the event a claimant provides any incorrect details on their claim, the Promoter shall not be liable for the gift not being awarded or being delivered to the wrong address. In either of these cases, the gift will be forfeited by the original claimant and no additional gift will be awarded. 

If the gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the gift with a gift to the equal value and/or specification. 

Gifts are not transferable or exchangeable and cannot be taken as cash. 

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: 

(a) to disqualify any entrant; or 

(b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 

The Promoter shall not be responsible for any delays in supply of the gift to the claimant. The Promoter shall additionally not be responsible for any delays caused as a result of inbound transportation, disruptions (including but not limited to strikes, weather, postage delays, etc.) which are caused by events, which are beyond the control of the Promoter and/or the supplier of the gift. 

In the event a gift received is damaged, the claimant must contact the Promoter via email rewardsau@legrand.com.au within 14 working days of receiving the prize. You’ll be asked to provide us with your order number and profile information to verify your identity. We may also require photos to verify your claim. 

Individual gifts are bound by warranties from the manufacturer. Your rights under these warranties are governed by the specific terms of the warranty. For any faulty items claims outside of Legrand manufactured products will be handled by our gift agent and proof of purchase will be distributed with the gift on delivery.  

As a condition of claiming a gift, each claimant must when requested sign any legal documentation as and in the form required by the Promoter in its absolute discretion.

The Promoter reserves the right to extend the promotion without notice and at their discretion. 

The Promoter shall use all reasonable efforts to ensure that all approved claims will be fulfilled within eight (8) weeks from the time the claim is submitted unless otherwise specified. The Promoter accepts no responsibility should the delivery take longer than eight (8) weeks for reasons beyond its reasonable control. 

Printing and other quality control errors will not invalidate an otherwise valid prize claim.  

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: 

(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); 

(b) any theft, unauthorised access or third party interference; 

(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

(d) any variation in prize value to that stated in these Terms and Conditions; 

(e) if the prize is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; 

(f) any tax liability incurred by a winner or entrant; 

or (g) use of a prize. 

The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at https://legrand.com.au/path-file/321 

In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
